FIQH AND USOOL AL-FIQHMAQAASID ASH-SHAREE‘AH (60 Hours)

I. OBJECTIVES
 
  1. Facilitating the understanding the spirit of legislation and clarifying the intent of the Legislator in legislating the laws and the revelation of Islamic laws in reality and enabling those engaged in Ijtihaad (legislative activity) to find Sharee‘ah solutions for new issues.
  2. Informing the student of the importance prioritizing benefits, balancing, determining the more correct when benefits conflict
  3. Enlightening the student to the social and economic issues and providing for him basic Fiqh rules to judge current issues.
II. CLASS CONTENT
Third Year
A. Defining the Maqaasid, identifying their importance and the need for them.
B. The relationship between Maqaasid and Fiqh
C. Categories of Maqaasid in the light of the goals of Islamic law.
D. The Five Comprehensive Principles and ways to protect them
E. The goal of the Legislator in establishing the Sharee‘ah
